1) Scope of Application1.1 These General Terms and Conditions (hereinafter referred to as "Terms") of eHunting SL (hereinafter referred to as "Seller"), apply to all contracts for the delivery of goods entered into by a consumer or entrepreneur (hereinafter referred to as "Customer") with the Seller regarding the goods displayed in the Seller’s online shop. The inclusion of the Customer's own terms and conditions is hereby objected to unless otherwise agreed.1.2 A consumer, within the meaning of these Terms, is any natural person entering into a legal transaction for purposes that predominantly are outside their trade, business, or profession.1.3 An entrepreneur, within the meaning of these Terms, is a natural or legal person or a partnership with legal capacity, acting in the exercise of their trade, business, or profession when entering into a legal transaction.

2) Conclusion of Contract
2.1 The product descriptions in the Seller's online shop are non-binding and serve as an invitation for the Customer to submit a binding offer.2.2 The Customer can submit an offer via the online order form integrated into the Seller's online shop. After placing the desired goods in the virtual shopping cart and completing the electronic order process, the Customer submits a legally binding offer to conclude a contract by clicking the button concluding the order process.2.3 The Seller may accept the Customer's offer within five days:

  • By sending the Customer a written order confirmation or an order confirmation in text form (e.g., email), or
  • By delivering the ordered goods to the Customer, or
  • By requesting payment from the Customer.

The contract is concluded at the time one of the above-mentioned alternatives first occurs. If the Seller does not accept the Customer's offer within the aforementioned period, this constitutes a rejection of the offer with the effect that the Customer is no longer bound by their offer.2.4 For payments made via PayPal, the contract is concluded at the time the Customer completes payment by clicking the order completion button.2.5 For payments made via other methods (e.g., Amazon Payments), the terms of the respective payment provider apply. Upon successful payment initiation, the Seller accepts the Customer's offer.2.6 The text of the contract is stored by the Seller and will be sent to the Customer after conclusion of the contract in text form (e.g., email). If the Customer has created a user account in the Seller's online shop, the order data will be archived and accessible to the Customer via their password-protected user account.2.7 Before submitting the order, the Customer can identify and correct input errors using the standard functions of their web browser and order form.2.8 Contracts are concluded in English and/or German, depending on the Customer's language selection.

3) Right of Withdrawal3.1 Consumers have a statutory right of withdrawal. Details are provided in the Seller's withdrawal policy.

4) Prices and Payment Terms4.1 All prices listed in the Seller's online shop are inclusive of statutory value-added tax (VAT). Additional delivery and shipping costs are indicated in the respective product descriptions.4.2 Payment options available to the Customer are listed in the Seller's online shop.4.3 Payments processed through third-party providers (e.g., PayPal, Amazon Payments) are subject to the terms and conditions of the respective provider.

5) Delivery and Shipping Terms5.1 Deliveries are made to the address specified by the Customer unless otherwise agreed. The specified shipping address in the Customer's payment profile (e.g., PayPal) may take precedence over other addresses provided.5.2 If delivery is unsuccessful due to reasons attributable to the Customer (e.g., incorrect address), the Customer bears any resulting costs. This does not apply if the Customer exercises their right of withdrawal.

6) Retention of TitleThe Seller retains ownership of the delivered goods until full payment of the purchase price has been received.

7) Defect Liability (Warranty)7.1 Consumers are entitled to statutory warranty rights. Entrepreneurs' claims are subject to a six-month limitation period from the date of delivery.7.2 The Seller’s liability for defects and damages is limited as outlined in the Liability section below.

8) Liability8.1 The Seller is liable for:

  • Intentional misconduct or gross negligence.
  • Damage resulting from injury to life, body, or health caused by negligence.
  • Mandatory legal provisions such as the Product Liability Act.

8.2 For slight negligence, the Seller’s liability is limited to damages foreseeable and typical for the type of contract, provided such negligence concerns essential contractual obligations.

9) Applicable Law All legal relations between the parties shall be governed by the laws of Spain, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers, this choice of law applies only to the extent that it does not deprive the consumer of mandatory protections provided by the law of the country in which they reside.

10) Alternative Dispute Resolution10.1 The European Commission provides an online dispute resolution platform athttps://ec.europa.eu/consumers/odr. This platform serves as a contact point for resolving disputes arising from online transactions.10.2 The Seller is not obligated or willing to participate in dispute resolution proceedings before a consumer arbitration board.
